Limits

In all cases, if you redistribute this product you must:

  • avoid any ambiguity about the product’s origin, which could suggest that you are the author. 

The term distribution here includes any delivery, even to a single customer, as well as the provision of services (hosting, SaaS mode).

Although the software is distributed as Open Source, it remains the property of the PROJEQTOR Company.

the data, images, and documents available on this site are the property of PROJEQTOR or their respective author.
Any distribution or reuse without the express consent of PROJEQTOR or its author is prohibited.

Explanation of the AGPL license

Starting with Version 6.0, ProjeQtOr changed its license from GLP V3 to AGPL V3. What does this change and why the change?

The GPL and AGPL licenses are very similar. GPL stands for GNU General Public License. AGPL stands for GNU Affero General Public License. It is also called GPL Affero. The GNU Affero General Public License (GNU AGPL) is a modified version of version 3 of the regular GNU GPL. It has only one additional requirement: if you run a modified program on a server and allow other users to interact with it, your server must also allow them to download the source code corresponding to the running modified version.

Why did we switch to this license? Simply to prevent a commercial company from “stealing” the product. They would make a few modifications, offer it as a SaaS solution, and invest their efforts in purely commercial development. This company would benefit from years of work in the design, development, and reliability of the product without ever having to contribute. This is absolutely not how we envision Open Source, and we want to protect ourselves from this kind of practice. With the AGPL license, a company that acts in this way would be obligated to distribute the source code to its users, who would then be free to redistribute it as they see fit, thus providing it to the original community, which could then freely integrate it into the original community tool.

One potentially ambiguous point is the notion of “other users”. Who does this include? Specifically, if I modify the code within my company, am I obligated to make the source code available to internal users (my company’s employees)? We want to clarify this ambiguity: for us, NO.

If we refer to the license, it mentions “public” distribution. We choose to acknowledge that, for us, use within a company is not public. It becomes public when distribution is made to a third party, whether a legal entity or an individual. ProjeQtOr will never seek to know what happens internally within your company. Therefore, you are perfectly free to modify the code of ProjeQtOr to adapt it to your specific needs, potentially by implementing processes you wish to keep confidential; we will not seek to have you disclose this code. However, if you modify the code to provide a service to third parties, for example, by offering a SaaS service, you fall under the scope of the license and are obligated to distribute the source code to your users, under the AGPL license.
